Booking photos are public records in Michigan. Patterson v. Allegan County Sheriff established that mugshots cannot be withheld under the privacy exemption. The ACLU v. Calhoun County ruling in 2022 went further, saying only state statutes can create FOIA exemptions. Federal regulations cannot block access. These rulings apply across the state, including Kent County.
